De rol van de (bedrijfs)arts De (bedrijfs)arts bevindt zich op het snijvlak van gezondheidszorg en het bedrijfsleven en heeft een onafhankelijke positie. Belangrijkste taken: - Adviseren over de arbeidsmogelijkheden van een werknemer. - Vaststellen van eventuele beperkingen die het werk beïnvloeden. - Zelden medicamenteuze behandelingen toepassen. - Onafhankelijk handelen, los van werkgever en werknemer. - Werken volgens richtlijnen van de NVAB of STECR . Zowel werkgever als werknemer verantwoordelijkheid voor de re-integratie. Dit start op dag één van de ziekmelding. Verplichte inzet van de (bedrijfs)arts Binnen de Wet verbetering Poortwachter (WvP) zijn er enkele verplichte evaluatie- en overlegmomenten. - Vangnetregeling: binnen vier dagen na de eerste ziektedag melden bij het UWV. - Psychische klachten: binnen twee weken. - Arbeidsconflict: zo snel mogelijk na het ontstaan van het conflict. Wet verbetering Poortwachter - protocol Wat kunt u verwachten van de (bedrijfs)arts? De (bedrijfs)arts ondersteunt een vlotte en verantwoorde terugkeer van een zieke werknemer, met aandacht voor diens mogelijkheden en beperkingen. Hij/zij geeft advies over een effectieve re-integratie. Verplichtingen werkgever en werknemer - De werknemer volgt het advies van de (bedrijfs)arts op. Bij niet opvolgen dient de werkgever sancties op te leggen. - Negeert de werkgever het advies, dan kan dit na 104 weken ziekte leiden tot een loondoorbetalings- verplichting in het derde jaar.
