The posting

Je bent het juridische aanspreekpunt voor aankopers, operationele diensten en directie voor alles wat met overheidsopdrachten te maken heeft, van plaatsingsstrategie tot uitvoering van het contract.

Je vertaalt complexe juridische vragen naar heldere aanbevelingen, zodat projecten veilig vooruitgaan.

Jouw belangrijkste taken

  • Adviseren over de keuze en motivering van de procedure: openbare procedure, onderhandelingsprocedure, raamovereenkomst, kwalificatiesysteem.
  • Bestekken, contractuele bepalingen en raamovereenkomsten opstellen en nalezen.
  • Gemotiveerde selectie- en gunningsbeslissingen opstellen en controleren.
  • Adviseren over de uitvoering: wijzigingen, prijsherzieningen, straffen, verbrekingen.
  • Klachten van inschrijvers behandelen en, samen met de advocaten van de klant, procedures bij de Raad van State voorbereiden.
  • Meewerken aan complexe constructies: PPS (DBFM), gezamenlijke opdrachten, aankoopcentrales, concessies.
  • De teams van de klant opleiden en de Belgische en Europese regelgeving opvolgen.
  • Master in de rechten; een specialisatie in publiekrecht of overheidsopdrachten is een troef.
  • Minstens 3 jaar ervaring als jurist overheidsopdrachten voor een medior profiel, 5 jaar voor een senior profiel, bij een aanbestedende overheid, een advocatenkantoor of een adviesbureau.
  • Grondige kennis van de wet van 17 juni 2016, de uitvoeringsbesluiten en de rechtspraak van de Raad van State.
  • Ervaring met ICT-opdrachten, PPS of openbaar vastgoed is een troef.
  • Nederlands en/of Frans: uitstekende beheersing,met een uitstekende juridische schrijfvaardigheid; goede kennis van de andere landstaal.
