L'OAD PolyReg è un organismo di autodisciplina (OAD) riconosciuto dall’Autorità federale di vigilanza sui mercati finanziari FINMA ai sensi dell'articolo 24 della legge sul riciclaggio di denaro (LRD). Conformemente al suo regolamento, l'OAD adempie ai suoi obblighi legali di sorveglianza e di controllo nei confronti dei suoi membri ed è sottoposto alla vigilanza dell'Autorità federale di vigilanza sui mercati finanziari FINMA. Si assicura che i suoi membri sorvegliati rispettino le disposizioni legali. Inoltre, PolyReg funge da ufficio di registrazione ai sensi dell'art. 31 della legge sui servizi finanziari (LSerFi) e gestisce il registro RegFix dei consulenti per i clienti.

Per la nostra succursale di Lugano siamo alla ricerca di un Legal \& Compliance Officer di madrelingua italiana, idealmente bilingue italiano\-tedesco o, in alternativa, con un'ottima padronanza della lingua tedesca. La posizione è dedicata alla succursale di Lugano, con sede di lavoro fissa presso la succursale stessa oppure presso la sede principale di Zurigo. Cerchiamo una persona affidabile, con solide conoscenze del diritto dei mercati finanziari, che si distingua per un metodo di lavoro autonomo, accurato, pragmatico e orientato alle soluzioni. Il Legal \& Compliance Officer risponde direttamente alla Direttrice, alla quale riferisce regolarmente in merito alle proprie attività.

Responsabilità:

La posizione offre un'attività varia nell'area della supervisione dei mercati finanziari e comprende, tra l'altro:

  • l’esame materiale di richieste d’affiliazione riguardo la conformità con il diritto dei mercati finanziari;
  • la sorveglianza continua degli intermediari finanziari affiliati all’OAD, compresa l'analisi dei rischi;
  • l’istruzione e il controllo di revisori, nonché valutare e registrare i rapporti di revisione;
  • la redazione indipendente di procedimenti sanzionatori nonché di procedimenti di diritto civile e pubblico e il contenzioso di procedure di incasso e arbitrali;
  • la gestione di tutte le questioni legali interne ed esterne;
  • le attività di co\-relatore in occasione di eventi formativi esterni.

Il Legal \& Compliance Officer ha inoltre il compito di gestire la succursale ticinese del Registro dei consulenti RegFix e di occuparsi dei consulenti clienti di lingua italiana. I compiti quotidiani si svolgono in lingua italiana e parzialmente in tedesco, inglese e francese. Il luogo di lavoro è al centro di Lugano o al centro di Zurigo e include viaggi tra Zurigo e Lugano siccome a .

Requisiti:

  • Master in diritto completato in un'università svizzera (MLaw) o esame di avvocato svizzero;
  • ottima conoscenza del diritto dei mercati finanziari e una prima esperienza professionale pertinente (p.e. presso un tribunale svizzero o presso un’autorità amministrativa);
  • madrelingua italiana con ottime capacità redazionali e analitiche, redazione stilisticamente sicura delle sentenze;
  • idealmente bilingue in tedesco, altrimenti almeno ottima conoscenza del tedesco; buone conoscenze dell’inglese e del francese sono un vantaggio;
  • persona affidabile con integrità e con stile di lavoro autonomo, diligente, efficace e orientata alle soluzioni.
