The Senior Legal Counsel, Go to Market Solutions, will have primary responsibility for legal support to Siemens Healthineers’ sales organization in the United States for diagnostic imaging equipment, advanced therapy solutions, laboratory diagnostics products, and related software and services. In doing so, the Senior Counsel, Go to Market Solutions, will lead a team of experienced attorneys and contract managers, advise business stakeholders on risks and mitigations, and ensure compliance with legal and regulatory requirements in commercial contracts. The position is a hybrid role, with generally one day per week in the Malvern, Pennsylvania office.

Essential Job Functions

  • Lead a team of experienced lawyers and contract managers with responsibility for drafting and negotiating a broad range of sophisticated and complex commercial contracts with healthcare organizations and sales channel partners. The commercial agreements include equipment sales, maintenance services, software, customer training, staffing solutions, business associate agreements, and confidentiality agreements, as well as agreements with channel partners such as sales agents, resellers, and marketing partners, which not infrequently involves innovating the nature and terms of contracting within the U.S. healthcare environments.
  • Actively counsel senior sales and field finance staff members (as well as executive leadership) on commercial law, healthcare regulations, fraud & abuse, privacy (including data privacy), and related topics.
  • Draft and update terms and conditions to address new offerings and new requirements, e.g., embedded AI.
  • Prepare and conduct training of sales, field finance, and other personnel on commercial law, regulatory matters, Siemens Healthineers’ templates, and other relevant topics.
  • Develop creative and compliant solutions to resolve intricate business challenges and complex customer disputes.
  • Educate and guide business stakeholders with regard to key commercial, competition, data privacy, cybersecurity, and significant regulatory considerations.
  • Negotiate with key customers and sales channel partners.
  • Provide ongoing counseling regarding (and efficient implementation of) various corporate policies, initiatives and/or programs.

Critical Competencies

  • Ability to lead a team of lawyers and contract managers to deliver excellent legal support within tight deadlines to a high-volume sales organization.
  • Proven ability to independently lead and execute all facets of challenging and intricate engagements and do so with highest integrity and ethics – from preliminary/conceptual advice, through structuring, negotiating, drafting, closing, and any subsequent conflict resolution.
  • Highly polished and effective negotiation, communication, listening, and drafting skills, including those suitable for interaction with senior managers and executive leadership within a global and matrixed organization and with senior management of key customers.
  • Expertise in U.S. healthcare legal and regulatory environments, including anti-kickback laws, fraud and abuse statutes, and privacy laws applicable to Siemens Healthineers as a medical device manufacturer, as well as those applicable to its customers.
  • Demonstrated skill in identifying and solving problems, including constructively engaging with relevant stakeholders and suggesting creative solutions.
  • Proven ability to manage heavy workload effectively and meet deadlines.
  • Strong written and oral communications skills.
  • Ability to perform in a complex cross-functional business environment.
  • Willingness and ability to travel occasionally (less than 10%).

Qualifications

  • Juris Doctor (JD) from an ABA accredited school and an active license and membership in good standing in at least one U.S. state bar.
  • At least 15 years of legal experience in a well-regarded law firm and/or the in-house legal department of a leading healthcare company; significant in-house experience a strong plus, especially within a publicly-listed company.
  • Experience with large hospital networks and/or medical device companies is strongly preferred.
  • Experience with structuring and negotiating intricate/complex contracts is preferred.
  • Strong skills in collaboration, working within cross-functional teams & change management.
  • Experience working in a multinational company is preferred.

Why it works

3×

more interviews than doing it yourself with ChatGPT.

ChatGPT writes a CV and never learns what happened to it. We see every reply. For each CV we know:

  • How it was written, and how the review scored it
  • When we applied, and how long after the posting went up
  • Which posting, which company, which city
  • Who got the interview, and who heard nothing

That is how we know which CVs get called.
